Papataka operates in a digital publication business and web based digital content retailer given territory in Indonesia, and is operated under the name, trademark and style of "Papataka". Papataka owns or has the right to use certain domain names, including "Papataka.com", and the trademarks "Papataka" and other related trademarks, tag lines, logos, design marks, patents and designs used in connection with the business and the system (the "Trademarks"). Papataka sells directly to you all kinds of books in various languages in eBooks format and you may purchase the eBooks by way of downloading the books through internet connection, pursuant to the terms and conditions contained herein.
By using and/or visiting this website (collectively, including all content and functionality available through the Papataka.com domain name, the "Papataka Website", or "Website"), you signify your agreement to these terms and conditions (the "Terms of Service").
Although we may attempt to notify you when major changes are made to these Terms of Service, you should periodically review the most up-to-date version. Papataka may, in its sole discretion, modify or revise these Terms of Service and policies at any time, and you agree to be bound by such modifications or revisions. Nothing in these Terms of Service shall be deemed to confer any third-party rights or benefits.
These Terms of Service apply to all users of the Papataka Website. The Papataka Website includes all aspects of Papataka, including but not limited to all products, software and services offered via the website.
In order to access some features of the Website, you will have to create a Papataka account. You may never use another's account without permission. When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. Papataka will not be liable for your losses caused by any unauthorized use of your account.
You agree and understand that you are responsible for maintaining the confidentiality of passwords associated with any account you use to access the services.
In order to access certain services, you may be required to provide information about yourself (such as identification or contact details) as part of the registration process for the services, or as part of your continued use of the services. You agree that any registration information you give to Papataka will always be accurate, correct and up to date.
Papataka shall not sell or rent any personal information and respect your personal preferences. Any transactions by credit card are handled by third party financial institutions and your entire card number will be encrypted via secure server and processed securely.
You shall pay to Papataka for every transaction made. The payment can be done by credit card or PayPal. Every transaction made by you can not be cancelled, returned and/or refunded for whatsoever reason.

Papataka hereby grants you permission to access and use the Website as set forth in these Terms of Service, provided that::

Content from eBooks and each copy thereof may only be obtained, in each and every instance, solely and directly from your global digital network using the specified software. You shall not (and shall not permit others to) in any way, shape or form alter any file transmitted, including but not limited to additions, appendages, insertions, deletions or changes in format. Further, you shall not (and shall not permit others to) display, copy, archive or otherwise distribute the electronic file(s) provided under these Terms of Service.
eBooks can be shared by you between the devices that are registered to the same Adobe Digital Edition Account. One title of eBook can be simultaneously shared up to 6 (six) number of devices.
Papataka will have the right to make reasonable deletions or additions to the eBooks from time to time.
In your use of the website, you will otherwise comply with the terms and conditions of these Terms of Service and all applicable local, national, and international laws and regulations.
Papataka reserves the right to discontinue any aspect of the Papataka Website at any time.
All rights, titles, ownership rights and intellectual property rights of the Papataka, including all data, information and records on Papataka and the Trademarks are the exclusive property of Papataka, notwithstanding the provision of Clause 6 of these Terms of Service.
Notwithstanding the provision of Clause 5.b above, you acknowledge and agree that the Trademarks has been registered to the proprietary of Papataka, therefore you are not entitled to use, reproduce or exercise the Trademarks and/or intellectual property rights.
You, for whatever reason, will not operate or do business under any name or in any manner that give the general public the impression that you, either directly or indirectly, associated, affiliated, licensed by or related to Papataka, and you will not, either directly or indirectly, use any trademark, name, logo, slogan, copyright, custom computer software, trade secret, confidential information, advertising, design, graphic, script, colour combination, distinguishing feature or other element which is confusingly similar to or colourably imitative of those used by Papataka.
You acknowledge that there is a certain amount of risk involved in the business contemplated by these Terms of Service due to the nature of internet technology and related software and equipment, as well as limitations which may arise from the quality and/or continuity of transmission providers, and you agree that Papataka have no responsibility or liability for any interruptions to such internet services.
You further acknowledge that Papataka ability to transmit electronic content files to you is dependant on the receiving an electronic content file or the file transmitted may be corrupt, and as such you agree that Papataka have no responsibility or liability in the event of such occurrence.
You agree that your use of the Papataka Website shall be at your sole risk. To the fullest extent permitted by law, Papataka, its officers, directors, employees, and agents disclaim all warranties, express or implied, in connection with the website and your use thereof. Papataka makes no warranties or representations about the accuracy or completeness of this site's content or the content of any sites linked to this site and assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content, (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our website, (iii) any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, (iv) any interruption or cessation of transmission to or from our website, (iv) any bugs, viruses, or the like which may be transmitted to or through our website by any third party, and/or (v) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the Papataka Website. You and any of your affiliates or successors shall defend, indemnify, protect, pay, compensate all losses and shall hold harmless Papataka and its officers, directors, employees, consultants, agents and affiliates, from and towards each and all liabilities, obligations, losses, damages, fines, claims, acts, decrees, charges and fees (including but not limited to attorney's fees) arising from: (i) any unauthorized use of your account or your use of and access to the Papataka Website; (ii) your violation of any term of these Terms of Service; (iii) your violation of any third party right, including without limitation to the assumption of a breach or a breach towards Trademarks, intellectual property rights, or other registered rights owned by third parties, any copyright, property, or privacy right. This defense and indemnification obligation will survive these Terms of Service and your use of the Papataka Website.
These Terms of Service, and any rights and licenses granted hereunder, may not be transferred or assigned by you in any manner, directly or indirectly, in whole or in part.
Entire Agreement
This Agreement, and the other agreements specifically contemplated by this Agreement, set forth the entire agreement between the parties and contain all of provisions, covenants and conditions agreed upon by the parties with reference to the subject matter of this Agreement. No other agreements, oral or otherwise, will be deemed to exist or to bind any of the parties hereto, and all prior agreements and understandings are superseded hereby.
Severability
In the event that any provisions of these Terms of Service or any portion thereof is held to be indefinite, invalid, illegal or otherwise void, avoidable or unenforceable, it will be severed from these Terms of Service and the remaining provisions will continue in full force and effect.
Ethics
You will at all times operate the eBooks honestly and ethically and so as not to depreciate the value of Papataka’s name and Trademarks and the image, identification, reputation and goodwill thereof.
Survival of Covenants
The terms and conditions of this agreement which by their nature require performance by you after assignment, expiration or termination of this agreement will remain enforceable notwithstanding the assignment, expiration or termination of this agreement for whatever reason.
You acknowledge to Papataka that you:
Have fully read and understand all of the provisions of these Terms of Service;
prior to executing this agreement, you have reviewed this agreement and agree that they are reasonable and necessary for the development and protection of the business and Trademarks for the benefit of Papataka; and
have not made any misrepresentations in applying for and obtaining the rights contemplated by these Terms of Service.
These Terms of Service and the rights and obligations hereunder will be governed by and construed in accordance with, the laws of Indonesia.
Any claim or dispute between you and Papataka that arises in whole or in part from your use of the Papataka Website shall be decided exclusively by a court of competent jurisdiction located in North Jakarta. These Terms of Service and any other legal notices published by Papataka on the Website shall constitute the entire agreement between you and Papataka concerning the Papataka Website.
The parties waive the provisions of Article 1266 of the Indonesian Civil Code if and to the extent applicable.
